BY USING THIS WEBSITE YOU REPRESENT THAT YOU ARE OVER 18 YEARS OF AGE OR IF YOU ARE UNDER 18 YEARS OF AGE, YOU HAVE THE CONSENT OF YOUR PARENT OR GUARDIAN TO ACCESS THIS SITE. YOU OR YOUR PARENT OR GUARDIAN FURTHER AGREE TO BE BOUND BY THESE TERMS OF USE, AND ANY SUBSEQUENT MODIFICATIONS, AND THE OTHER POLICIES POSTED ON THE WEBSITES.

Your electronic acceptance of these terms of use and other posted policies through your use of this website shall have the same force and effect as if you had actually signed an agreement embodying these terms. St James Ethics Centre may change these terms of use at any time by posting changes on this website. It is your responsibility to review these terms of use prior to each use of the website. By continuing to use the website, you agree to any such changes.

The fora, comment facilities and other interactive areas of the website are provided by St James Ethics Centre for the discussion and exploration of responsible business practices, ethics and associated topics. All are welcome to participate in these interactive areas. However, note that St James Ethics Centre does not necessarily support or share the views expressed by any individuals on this website. 

2. Email addresses

Registration requires that the user have a valid email address. You will be required to click on a link sent to you in an email to activate your account and your email will be used to assist you retrieve your password if you lose it.

St James Ethics Centre will not use the email address provided as part of your website user account to contact you other than as part of administration of your website account. The Centre will also not knowingly pass on your contact details without your consent unless legally obliged to do so.

If you choose to reveal your email address or other contact details within forum posts or comments on this website, you do so at your own risk. The Centre strongly advises you not to do this.

Our use of your personal information is governed by our Privacy Policy, which can be found at http://thehub.ethics.org.au/legal/privacy_policy/

3. Content

The discussion fora and various comment areas on this site consist of unmoderated user-added content. While St James Ethics Centre will make every effort to quickly remove spam, offensive material or other items which are in breach of its terms of user, the onus is on site users to avoid unmoderated content areas should they wish to not risk viewing such content.

By submitting content, you warrant that that content is owned by you, is not confidential to or owned by any other person, and does not breach any applicable laws or the rights of any other person, including intellectual property rights.

Our discussion fora and comment areas are not link pages and are not meant for publicising web pages. It is acceptable to list URLs and refer to web pages in discussing ethics-related and responsible business issues in the fora and comments pages. Postings which consist of little more than a link to another website rather than discussion in keeping with the topic at hand will be removed. Member accounts which appear to have no purpose other than including a website link in their forum profiles will also be removed. Any other postings or profiles deemed to be spam or otherwise in breach of the terms of service by the website administrators will also be removed. Contact us if you believe this has been done in error.

Posting of a person's personal information without their consent (personal phone numbers, private email addresses, home addresses, social security numbers, etc.) is prohibited. Postings of this nature will be removed.

Impersonating other users, persons or businesses is prohibited. Choosing a username or signing messages with a name to wilfully cause confusion or deception is prohibited. Postings of this nature will be removed.
This website must not be used to post any material which is vulgar, defamatory, threatening, invading of others' privacy, sexually oriented or in violation any laws in your own country or Australia, including intellectual property laws. Postings of this nature will be removed.

Posts that are deemed to be in violation of these policies in any way will be removed at our discretion. Seriously offensive posts or ongoing personal attacks will result in the member being banned from the website.

No copyrighted material may be posted unless permission is obtained from the copyright owner or is otherwise acceptable in relation to copyright legislation. The Centre does not accept responsibility for posts or comments made by individual site members which are in breach of copyright legislation, but will remove such posts if requested by the copyright owners.

By posting to the fora on this website you are giving St James Ethics Centre permission to publish the content you write for this purpose on the fora on this website.. You have no inherent right to have your content subsequently unpublished; however, we will consider such requests if there is a valid reason.

Note that St James Ethics Centre reserves the right to remove any content or members from its website, to cancel or suspend any member’s account, remove any business from the Good Business Register or to refuse any person access to the website or any part of the website, for any reason at its own discretion.

4. Indemnity

You remain solely responsible for the content of your messages, and you agree to indemnify and hold harmless the St James Ethics Centre, the fora on this website and the St James Ethics Centre’s agents with respect to any claim, action, demand, liability or settlement based upon your use of this website and any post you may make, or your violation of these terms and conditions.

5. Reporting violations

Posts or comments which violate the terms of this agreement should be reported immediately to the website administrators using the contact us form or using the 'report post' link in each forum post. Please do not abuse this mechanism with petty complaints or fallacious reporting.

6. Use of site at own risk

Your use of this website is at your own risk. You must evaluate and bear all risks associated with the use of any material or content, including reliance on the accuracy, completeness or usefulness of any material or content. In particular:

(i) we do not guarantee that that your requirements will be met or that any content will be uninterrupted, error free or that the website or the server that operates it is free of viruses or other harmful components; and

(ii) while we may attempt to keep information on the website current and accurate, we do not make any warranties or representations about the currency and accuracy of any information on the website.

(b) If your use of the website results in the need for servicing or replacing property, material, equipment or data, we will not be responsible for such costs.

Without limiting the above provisions, to the extent permitted by law, everything on the website is provided to you “as is” and “as available” without warranty or condition of any kind, either expressed or implied, including, but not limited to, any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We exclude all representations and warranties to the fullest extent permissible under applicable law.

7. Limitation of liability

To the maximum extent permitted by law:

(i) we have no liability to you, whether for breach of these terms, in negligence, in any other tort, in equity or for any other common law or statutory cause of action arising in relation to these terms, the website, or any related content;

(ii) we will not be liable for any direct, incidental, consequential or indirect damages, loss or corruption of data, loss of profits, goodwill, bargain or opportunity, loss of anticipated savings or any other similar or analogous loss resulting from your access to, or use of, or inability to use the website, or any content, whether based on warranty, contract, tort, negligence, in equity or any other legal theory, and whether or not we know of the possibility of such damage; and

(iii) our liability for breach of any implied warranty or condition which cannot be excluded is limited at our option to the following:

(A) in the case of goods: (A) the replacement of the goods or the supply of equivalent goods; (B) the repair of such goods; (C) the payment of the cost of replacing the goods or acquiring equivalent goods; or (D) the payment of the cost of having the goods repaired; and

(B) in the case of services: (A) the supply of the services again; or (B) the payment of the cost of having services supplied again.

8. Variation of the website

You acknowledge that we may, in our sole discretion and without notice, vary, modify or discontinue, temporarily or permanently, any or all of this website and you agree that we are not liable to you or any third party for such variation, modification or discontinuance.

We have not reviewed all of the sites linked to this website and are not responsible for the content or accuracy of any off-site pages or any other sites linked to this website. The inclusion of any link does not imply that we endorse the linked site, and you use the links at your own risk.
